These Terms & Conditions (“Terms”) govern your use of the mobile game SPAN (the “Game”) and this website, provided by Software KiT SRL (“we”, “us”, “our”), a company registered in Romania. By downloading, accessing, or using the Game, you agree to these Terms. If you do not agree, do not use the Game.

1. Eligibility

You may use the Game only if you can form a binding contract under the laws of your country, or have the consent of a parent or legal guardian. You are responsible for ensuring your use of the Game complies with the laws that apply to you.

2. Your Account

You are responsible for your account and for activity that occurs under it. Provide accurate information, keep your sign-in credentials secure, and notify us of any unauthorized use. Usernames are moderated; we may change or reclaim a username that is offensive, impersonating, or otherwise violates these Terms.

3. License

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the Game for your own non-commercial entertainment. We reserve all rights not expressly granted.

4. Fair Play

You agree not to:

• use bots, scripts, automation, solvers, or any tool that gives an unfair advantage;
• exploit bugs, manipulate matchmaking or ratings, or interfere with other players;
• reverse engineer, decompile, or tamper with the Game except as permitted by law;
• access the Game through unauthorized means or disrupt our servers.

We may detect suspected cheating and may warn, restrict, reset ratings, suspend, or terminate accounts that violate fair-play rules.

5. Purchases, Subscriptions & Virtual Items

• The Game may offer one-time purchases (such as ad-removal) and auto-renewing subscriptions. All purchases are processed by the Apple App Store or Google Play under their terms.
• Subscriptions renew automatically until cancelled. You can manage or cancel a subscription in your App Store or Google Play account settings; cancellation takes effect at the end of the current period.
• Virtual items and entitlements have no monetary value, cannot be exchanged for cash, and are licensed, not sold, to you.
• Refunds are handled according to the policies of the relevant app store, and by applicable law (including any statutory withdrawal rights for EU consumers).

6. No Pay-to-Win

Purchases never affect board difficulty, your skill rating, or matchmaking. Boards are the same for both players in a match. Monetization is limited to cosmetic and convenience features such as removing ads.

7. Advertising

The free version of the Game shows advertising provided by third parties. Your interactions with advertisers are between you and them. See our Privacy Policy for how advertising data and consent are handled.

8. Intellectual Property

The Game, including its software, artwork, branding, and content, is owned by us or our licensors and is protected by intellectual-property laws. The numberlink puzzle mechanic itself is in the public domain; our specific implementation, design, and assets are not. You may not copy, distribute, or create derivative works from the Game except as permitted by law.

9. Disclaimers

The Game is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Game will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Game. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory consumer rights.

11. Termination

You may stop using the Game at any time and delete your account from Settings → Delete account & data. We may suspend or terminate access if you violate these Terms or where necessary to protect the Game or other players.

12. Changes

We may update these Terms from time to time. We will update the “Last updated” date above and, where appropriate, notify you in the Game. Continued use after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict-of-laws rules. Disputes are subject to the competent courts of Romania, except where mandatory consumer-protection law gives you the right to bring proceedings in your country of residence.
